These aren't just any applicants – they are the digital mavens of our time, the OnlyFans stars and TikTok influencers, who are stepping into the spotlight with their extraordinary abilities.
The O-1 visa, intended for those with "extraordinary ability" in fields ranging from science to the arts, is now being sought after by content creators who have captivated global audiences. According to U.S. Citizenship and Immigration Services (USCIS), these visas recognize individuals with national or international acclaim, and the application must be filed by a U.S. employer or agent.
“O-1B visas have been dominated by influencers and content creators,” says Raymond Lahoud, an immigration attorney. “We see applicants with millions of followers and earnings to match.”
During the pandemic, the world turned to digital platforms for entertainment and connection, providing a fertile ground for influencers to grow their following. "While films were paused, influencers were actively posting," Lahoud remarks, noting the recent phenomenon of creators seeking these coveted visas.
A State Department spokesperson revealed that O-1 visa issuances have remained steady at around 20,000 for fiscal years 2024 and 2025. This consistency reflects the continued demand for recognizing digital stars as legitimate applicants for these visas.
The criteria for O-1 visas rely on a flowchart system, ensuring that those who meet the minimum qualifications receive approval promptly. Lahoud highlights the ease brought by digital platforms in gathering metrics and data, making the process smoother for influencers compared to traditional applicants.
However, the debate continues on how digital fame is evaluated against traditional achievements. Lahoud points out, "An influencer is no different from a writer or any other job position," emphasizing that the digital era has redefined what it means to be a performer. "The reach of an OnlyFans film can transcend borders faster than any traditional media," he adds, underlining the global impact of these modern-day stars.
